    What compliance rules apply when AI contacts my customers?

    Short answer

    Automation does not create an exemption from anything. Consent, honest identification, working opt-outs, and message registration all still apply, and several states now add specific disclosure requirements for automated callers. This is general information, not legal advice.

    The basics — registration, consent records, opt-out handling — are entirely manageable in-house and you should understand them regardless of who builds your systems.

    A partner should arrive with these built in by default rather than leaving them as configuration you discover later.

    Consent is about the record, not the intent

    Being able to demonstrate consent matters more than having it. Log where and when it was captured, what the customer agreed to, and keep it attached to the contact record. An existing service relationship is not automatically consent for marketing messages.

    Messaging has its own machinery

    Business text messaging in the US requires brand and campaign registration before carriers will deliver reliably, and unregistered traffic gets filtered rather than rejected loudly. Opt-out keywords must work immediately and across every system that might message that person.

    • Identify your business in the message
    • Respect quiet hours in the recipient's local time

    Disclosure for automated voice

    Several states have introduced requirements that an automated caller identifies itself as such, and recording consent rules vary — some states require all parties to agree. Configure disclosure and recording behaviour to the strictest rule across your service area rather than per call.

    One opt-out list, always

    The most common failure is a customer who opts out in one tool and keeps receiving messages from another. This is a direct consequence of disconnected systems, and it is the compliance problem that most often turns into a complaint.

    • A campaign sent from a tool that never received the global opt-out list
    • Unregistered messaging traffic silently filtered by carriers
    • Call recording enabled uniformly across states with different consent rules
